Municipal and Expropriation Law

Municipal law is a complex area of law often involving multi-faceted expertise, multiple tiers of government and far reaching legislation and policy. Rodrigues Paiva LLP acts for municipalities, developers, property owners and corporations faced with complex and fundamental municipal issues.

The lawyers at Rodrigues Paiva LLP are experienced advocates before the Ontario Municipal Board, Committee of Adjustment and Superior Court of Justice in relation to land use planning appeals, development charge matters, expropriation compensation claims, by-law challenges and general land development matters. We also assist clients in navigating the newly formed Local Planning Appeal Tribunal (“LPAT”) and Toronto Local Appeal Body (“TLAB”). We are dedicated to resolving municipal law matters in Toronto and throughout the GTA, Waterloo Region and throughout Southwestern Ontario.

We strive to build the strongest possible case for our clients and have extensive professional relationships with knowledgeable and litigation-tested expert witnesses. We believe in thorough but efficient case preparation and make no compromises in advancing our clients’ interests. We only settle matters if a satisfactory outcome can be reached without a hearing.

Land Use Planning

We have successfully advocated for our clients at the Ontario Municipal Board and can assist your firm through the land development process with appeals relating to official plans, zoning by-laws and the re-zoning of lands, plans of subdivision and severances, site plans and minor variances. We have acted for developers of multi-use properties and vacant lands to reach their development goals.

We have extensive experience identifying and building the appropriate expert witness teams necessary to advance your development project and appeal to the Ontario Municipal Board in the strongest possible manner.

Expropriation Law

We assist land and business owners in expropriation claims. We have a thorough and specialized understanding of the complex Expropriations Act, and the related case law necessary to advance a strong compensation claim. We regularly assemble and work with teams of experienced land use planners, real estate appraisers, business loss valuators and other experts to ensure that the strongest and most supported compensation claim is made.

The lawyers at Rodrigues Paiva LLP explore every avenue of compensation and leave no stone unturned. The Section 25 offer that the expropriating authority must provide to owners rarely captures the full extent of the compensation you are entitled to. We will ensure that you are awarded full and fair compensation and will advance your claim accordingly to the Ontario Board of Negotiation and Ontario Municipal Board.

Development Charges

We work with land developers, builders and institutions in development charge matters. With our extensive knowledge of the Development Charges Act, we can review development charges imposed by a municipality to ensure that the charges are calculated correctly and consistently with the language in the municipal by-law. We consider every possible exemption, measurement and classification to ensure that the development charge is fairly calculated. We also review municipal by-laws and their background studies to ensure that these documents are consistent with the Development Charges Act.

We advocate for clients who wish to dispute a charge or by-law, all the way to an appeal at the Ontario Municipal Board.
